It applies to residents of the United States. The Site is intended for adults and for use in the United States only.
2. Personal Information We Collect
In the past 12 months we have collected the following categories of personal information:
| Category | Examples | Source |
|---|---|---|
| Identifiers | name, email address, phone number, shipping and billing address, IP address, cookie and device identifiers, customer and order numbers | you; your device; our service providers |
| Customer records | contact details, payment confirmations (we do not receive or store full card numbers) | you; payment processors |
| Commercial information | products viewed, added to cart, purchased, returned or refunded; subscriptions; discounts used | you; your device; Shopify; Loop Subscriptions |
| Internet or other electronic network activity | pages visited, links clicked, scrolling, referring website, time on page, browser and device type, interactions with our emails and text messages | your device, through cookies, pixels and similar technologies (Section 4) |
| Approximate geolocation | city, state or region derived from your IP address or shipping address | your device; you |
| Communications | emails, messages, reviews and survey answers you send us | you |
| Inferences | shopping preferences, such as which offers or products you may like. We do not create inferences about your health. | derived from the categories above |
Information about other people. If you give us personal information about another person, for example a gift recipient's name and address, you confirm that you are allowed to do so.
Sensitive and health information. We do not ask you for health information and we do not need it to sell our products; please do not send us health information we have not asked for. We are not a healthcare provider, and the Health Insurance Portability and Accountability Act (HIPAA) does not apply to information you give us. If you choose to tell us about symptoms, side effects, allergies or a medical condition (for example in a support message, a return request or an adverse-event report), we use that information only to respond to you; to handle your order, refund or return; to record, review and report adverse events and product-safety issues; to detect and prevent fraud and secure our services; and to meet our legal obligations. By sending it to us, you consent to that use. You may withdraw your consent at any time by asking us to delete the information, except where the law requires us to keep it.
3. How We Use Personal Information
We use personal information to:
- process, fulfill, ship and track your orders and subscriptions, and handle payments, refunds and returns;
- provide customer support and communicate with you about your orders and account;
- send marketing emails if you signed up for them or agreed to receive them at checkout, and, with your prior express written consent, marketing text messages (see our SMS & Email Terms);
- show, personalize and measure advertising on our Site and on other websites and apps;
- analyze and improve the Site, our products and our offers, including by combining information from different sources to understand your shopping interests and preferences;
- detect, prevent and investigate fraud, abuse, chargebacks and security incidents;
- comply with law, respond to lawful requests, enforce our Terms of Service, protect our rights, establish, exercise and defend legal claims, and make insurance claims.
We do not use automated decision-making to make decisions that produce legal or similarly significant effects about you.
4. Cookies, Pixels and Similar Technologies
We and our partners use cookies, pixels, tags, software development kits, server-side connections and similar technologies. Some of them collect information directly from your browser, over time and across different websites, while you use the Site:
- Shopify (our e-commerce platform) — makes the Site, cart and checkout work and provides analytics.
- Meta Pixel and Meta Conversions API (Meta Platforms, Inc.) — receive the pages you view, products you view or add to your cart, checkout steps and purchases, together with identifiers such as your IP address, browser and cookie identifiers and your hashed (encoded) email address, to show you ads on Facebook and Instagram and to measure them.
- Google Analytics and Google advertising services (Google LLC) — receive similar Site activity and identifiers for analytics and advertising measurement.
- Klaviyo (our email and text-messaging platform) — records Site activity such as viewed products and started checkouts, linked to your email address or phone number when you have given them to us, to send cart and browse reminders and other messages on our behalf.
- Loop Subscriptions and ParcelPanel — manage subscriptions and order tracking.
We do not send phone numbers to Meta, Google or any other advertising partner. The product and page information these partners receive shows what you looked at or bought on our Site; we do not use it, or ask our partners to use it, to identify your health status or to target ads to you based on a health condition.
Where the law requires consent, we ask for it through our cookie banner before advertising and analytics technologies are loaded, and you can change your choice at any time through the banner or our Your Privacy Choices page. You can also block or delete cookies in your browser; some parts of the Site may not work without them. Blocking cookies does not stop all disclosures, because some information is sent from our servers (for example through the Meta Conversions API); to opt out of those disclosures, use our Your Privacy Choices page or Global Privacy Control (Section 7).
Do Not Track. Browsers' "Do Not Track" signals have no common standard, and we do not respond to them. We do honor Global Privacy Control (Section 7).
5. How We Disclose Personal Information
We disclose personal information to:
- Service providers and processors that act on our behalf under contracts that limit their use of it: Shopify (hosting, store and checkout), payment processors (Shopify Payments, Shop Pay, PayPal, Apple Pay, Google Pay), Loop Subscriptions (subscriptions), Klaviyo (email and text messaging), ParcelPanel (order tracking), our fulfillment warehouse and shipping carriers (USPS, UPS and others), customer-support, fraud-prevention and IT providers, and our professional advisers, such as lawyers, accountants and insurers.
- Advertising and analytics partners: Meta Platforms, Inc. and Google LLC, as described in Sections 4 and 6. They use the information they receive under their own privacy policies.
- Shopify for its own services. Our store is hosted by Shopify, which collects and processes personal information of visitors and customers, including for its own services. See the Shopify Consumer Privacy Policy and, to opt out of certain Shopify uses, our Your Privacy Choices page.
- Authorities and others when we believe in good faith that the law or legal process requires it, to respond to lawful requests from public authorities, to report serious adverse events to the U.S. Food and Drug Administration, to enforce our agreements, to respond to an emergency, or to protect the rights, property or safety of us, our customers or others.
- A buyer or successor in a merger, acquisition, financing, sale of assets, reorganization, bankruptcy or similar transaction, including during its negotiation.
- Anyone else with your consent or at your direction.
6. "Sale" and "Sharing" of Personal Information
In the past 12 months we have "sold" or "shared" (as those terms are defined in state privacy laws such as the California Consumer Privacy Act) the following categories of personal information to Meta Platforms, Inc. and Google LLC, for cross-context behavioral advertising and ad measurement: identifiers, commercial information, internet or other electronic network activity, and inferences. We do this through the technologies in Section 4. Meta Platforms, Inc. and Google LLC are the only third parties to which we have sold or shared, or may sell or share, personal information, apart from Shopify's use for its own services described in Section 5, which some state laws may also treat as a sale or sharing.
We do not sell or share sensitive personal information, including health information you give us. We have no actual knowledge that we sell or share personal information of consumers under 16 years of age.
7. Your Privacy Choices
- Opt out of sale, sharing and targeted advertising: use our Your Privacy Choices page or email hello@tryfemvia.com with the subject line "Do Not Sell or Share." You do not need an account, and we do not verify your identity for an opt-out. We act on your opt-out as soon as feasibly possible and no later than 15 business days after we receive it.
- Global Privacy Control: if your browser sends a Global Privacy Control signal, we treat it as a request to opt out of the sale and sharing of personal information and of targeted advertising for that browser and, if we know who you are, for your customer record. We do this for visitors from every state. If you clear your cookies or use another browser or device, you may need to opt out again there, unless we know who you are.
- Marketing emails: click "unsubscribe" in any marketing email.
- Text messages: reply STOP to any message (see our SMS & Email Terms).
- Advertising settings: you can also adjust ad preferences in your Meta and Google accounts. These settings add to, and do not replace, the choices above.
8. Your State Privacy Rights
Depending on your state of residence (including California, Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah and Virginia), you may have the right to:
- know and access the personal information we have collected about you, including the categories, sources, purposes and recipients;
- delete personal information we have collected from you;
- correct inaccurate personal information;
- receive a copy of your personal information in a portable format;
- opt out of the sale or sharing of personal information, targeted advertising and profiling in furtherance of decisions with legal or similarly significant effects;
- limit the use of sensitive personal information (we use it only for purposes for which the law does not give this right);
- not be unlawfully discriminated against for exercising these rights.
How to make a request. Email hello@tryfemvia.com with the subject line "Privacy Request," or use our Your Privacy Choices page for opt-outs. For access, deletion and correction requests we verify your identity by matching information you provide with information we hold, such as your email address and a recent order number, and we may ask you to confirm your state of residence. An authorized agent may submit a request with your signed permission; we may ask you to confirm your identity directly with us.
Timing. We respond to access, deletion and correction requests within 45 days. If we need more time, we tell you within those 45 days and take up to 45 more days, as the law allows.
Appeals. If we decline your request, you may appeal by replying to our decision with the subject line "Privacy Appeal." We answer appeals within the time your state's law sets. If you are not satisfied with the result, you may contact your state's Attorney General.
We may decline or limit a request as the law permits, for example when we cannot verify it or when we must keep information to complete a transaction, detect fraud, comply with law, or establish, exercise or defend legal claims. Where the law allows, we may charge a reasonable fee for, or decline, requests that are manifestly unfounded, excessive or repetitive.
9. Retention
We keep each category of personal information only as long as reasonably necessary for the purposes in this policy. We decide how long by these criteria:
| Category | How long we keep it |
|---|---|
| Identifiers, customer records and commercial information | While you have an account, a subscription or an open order with us, and afterwards for as long as we need them to handle returns, refunds, payment disputes and product-safety matters, to meet our tax, accounting and record-keeping duties, and to establish, exercise or defend legal claims until the limitation periods for those claims have run. We keep records of your consent to a subscription for at least three years, or one year after the subscription ends if that is longer. |
| Internet or other electronic network activity | For as long as we need it to operate, secure and improve the Site and to measure the advertising or analytics campaign it relates to, as set in the retention settings of the technology concerned. Information that Meta and Google hold is kept under their own policies. |
| Approximate geolocation | For as long as we keep the record it was derived from (your shipping address or your Site activity). |
| Communications | For as long as we need them to answer you and to deal with any follow-up, refund or claim. Adverse-event and product-safety reports are kept for as long as the law requires. |
| Inferences | Until they are no longer current or you opt out of marketing, and never longer than the records they were derived from. |
| Text-message and email consent and opt-out records | Consent records for as long as we send you messages and afterwards until the limitation periods for claims about those messages have run. Your opt-out is kept permanently so that we never message you again by mistake. |
In every category, information needed for a legal claim, fraud investigation, chargeback, litigation hold or government investigation is kept until the matter is resolved. When we delete information, copies may remain in backup systems for a limited period until they are overwritten, within the time the law allows. We may de-identify information so that it can no longer reasonably be linked to you; we then keep it in de-identified form, do not try to re-identify it, and may use it for any lawful purpose.
10. Notice at Collection
At or before the point of collection, this notice applies: we collect the categories of personal information listed in Section 2 for the purposes listed in Section 3; we sell or share identifiers, commercial information, internet activity and inferences as described in Section 6; we keep each category as described in Section 9; and you can opt out on our Your Privacy Choices page.
11. Notice of Financial Incentive
Members of our email or text-message list receive member-only offers, such as discount codes and early access to sales. Each offer states its discount. This is a "financial incentive" under California law.
- Personal information involved: your email address and/or mobile phone number, and your interactions with our messages.
- How to join: by submitting a sign-up form that describes the offer. Joining is voluntary and is your opt-in to the incentive.
- How to withdraw: unsubscribe from emails or reply STOP to texts at any time. A discount code you already received stays valid under its own terms.
- Value of your data: we estimate the value of your personal information to be equal to the dollar value of the discount stated in the member offer you use; for example, a 10% discount on a $40.00 order has a value of $4.00. We calculated this value from the expenses related to the offer, that is, the cost of the discount to us.
12. Mobile Information and Text Messages
This Section applies to the phone numbers and consent you give us for our text-message program, and it takes precedence over any other statement in this policy.
We do not share, sell, or provide your mobile phone number or messaging consent data to third parties or affiliates for marketing or promotional purposes. We disclose this information only to the service providers that deliver our text messages (our messaging platform and wireless carriers) and only to provide the messaging program you signed up for. All other disclosures described in this policy exclude text-messaging originator opt-in data and consent.
If you sign up for text messages, message frequency varies, and message and data rates may apply. We may send cart and browse reminders; we detect an abandoned cart through cookies and similar technologies on the Site that record the products you add and the checkout steps you start (Section 4). Reply STOP to cancel and HELP for help at any time.
13. Nevada Residents
Consumer Health Data Privacy Policy for Nevada. This Section is our consumer health data privacy policy under Nevada law.
- Categories collected and how we use them: health information you choose to give us (symptoms, side effects, allergies, medical conditions and adverse-event reports) and the order, refund and return information linked to it. We use it only for the purposes listed under "Sensitive and health information" in Section 2.
- Sources: directly from you; our records of your orders; our service providers acting on our behalf.
- Categories shared: the categories listed above, only as necessary for those purposes, as the law requires, or with your consent.
- Categories of third parties: our e-commerce platform and hosting provider; payment processors; our fulfillment warehouse and shipping carriers; our subscription-management, customer-support, email and text-messaging providers; and government authorities, including the U.S. Food and Drug Administration, where the law requires. We have no affiliates that receive consumer health data.
- How it is processed: electronically, in our e-commerce, customer-support and messaging systems, and only by personnel and service providers who need it for the purposes above.
- Tracking across websites: our advertising and analytics partners collect information about your use of the Site over time and across different websites (Section 4). That information is used to understand shopping habits and interests, not to identify your health status. We do not allow third parties to collect consumer health data through the Site.
- Your requests: to confirm whether we collect, share or sell your consumer health data; to access, delete or correct it; to receive a list of all third parties with which we have shared it or to which we have sold it; to have us stop collecting, sharing or selling it; or to withdraw your consent, email hello@tryfemvia.com with the subject line "Consumer Health Data Request." We respond within 45 days after we authenticate your request, and we may extend that period once by up to 45 days where reasonably necessary, with notice and our reasons. You may appeal a refusal by replying with the subject line "Consumer Health Data Appeal"; we answer in writing within 45 days and, if we still decline, give you the contact information of the Nevada Attorney General.
- Changes: we notify you of material changes as described in Section 18.
Sale of covered information. We do not sell covered information, as Nevada law defines "sale." You may still direct us not to sell your covered information by emailing hello@tryfemvia.com with the subject line "Nevada Do Not Sell." We respond within 60 days.
14. Children
The Site and our products are intended for adults 18 and older. The Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If we learn that we have collected such information, we delete it, and we may also delete information we learn was provided by anyone under 18. Contact us if you believe a child has given us personal information.
15. Security
We use administrative, technical and physical safeguards designed to protect personal information, and our checkout runs on Shopify's payment-card-industry (PCI) compliant platform. No method of transmission or storage is completely secure. If a security breach affects your personal information, we notify you and the authorities as required by applicable law.
16. Where Your Information Is Processed
We operate from the United States. Our service providers may process personal information in the United States and in other countries, under contracts that require them to protect it.
17. Links to Other Websites
The Site may link to websites and services we do not control, such as social networks and payment providers. Their own privacy policies govern your information there, and we are not responsible for their privacy practices.
18. Changes to This Policy
This policy takes effect on the "Last updated" date above. We review it at least once every 12 months. When we change it, we update that date. If a change materially affects how we use personal information we have already collected, we notify you by email or a notice on the Site before the change takes effect and, where required by law, ask for your consent.
